Here are just a few of the 5000+ schools using biometric related systems, arranged by Local Education Authority. We will be adding more soon, and hope to have a full list within the next 12 months.

We've confirmed nearly 400 schools so far, but we know that there are many thousands more (in fact, at least 3500 schools use a system from one manufacturer alone - that's an average of around 20 schools fingerprinting children per Local Education Authority). There are now more than 15 private companies promoting this technology. And more than 20 new schools a week are starting to fingerprint our children. This is an out-of-control epidemic that's got to be stopped!

However a copy of the Report No 997/02 which was approved by the Education Committee at its meeting in August 2002 is attached. This report established the policy for schools wishing to use Identikit systems as part of library management systems, the only area where such technology is used within schools in the Angus area."

How many of the following educational institutions within your area, currently use a biometric identifying system (eg fingerprint scanner) for any purpose: " Although the attached Committee Report refers to all eight secondary schools and one primary school either using or proposing to use the system, some of the secondaries do not in fact use it for operational reasons. The current situation is that 4 secondary schools and 2 primary schools within the Angus area use the Identikit system in their libraries. For the other educational institutions you refer to, the answer is therefore zero."

"The schools currently using the Identikit system referred to above within the Angus area are: Arbroath High School , Brechin High School , Montrose Academy, Webster's High School , Andover Primary School, Rosemount Primary School. "Arbroath High School - at present the school is awaiting re-installation of the software so it has not been used this year. The school includes information about it in the Information and Communications Technology agreement form which parents/guardians are asked to sign.
    Brechin High School -the new intake receives information about it in the library induction leaflet given to all primary pupils about to start in the secondary school and parents/guardians on Induction Day with an invitation to contact the school if they wish further information. The school handbook also refers to it and again invites parents/guardians to contact the school for more information and to advise in writing if they have any objections. Information will also be on the school website in due course.
    Montrose Academy - the new intake receives information with their Induction Pack and it is demonstrated to parents/guardians who attend the Induction evening with an invitation to contact the school if they wish further information about the system.
    Webster's High School - has included details about it in the Information and Communications Technology agreement form which parents / guardians have been asked to sign.
    Rosemount Primary School - the School sends out a form to new P1 parents/guardians every year which they are required to sign to either give or refuse their permission.
    Andover Primary School - the School has flagged up use of the system in their newsletter to parents/guardians and are including it in their Information and Communications Technology agreement for parents/guardians of new pupils to sign. "

  6. Please supply details of any proposed implementation of biometric systems in educational establishments, within your area, with regards to the government's Building Schools for the Future programme or any educational establishment renovation programme. " A third primary school has bought the system referred to above and is considering introducing it later this year but it is not part of the PPP or a refurbishment programme. "

Supporting Guidance on extraction of bio-metric data for proposes of electronic registration

Schools will wish to take into consideration the following advice issued by the DfES:

Schools and Local Authorities (LA) are responsible for deciding their own policies relating to information about children which they wish to hold and use, subject to the relevant legislation on Data Protection and Freedom of Information. It is for each school to decide whether or not to collect pupils' biometric data.

In collecting data of this type the school will rely on the broad powers contained in paragraph 3 of Schedule 1 of the Education Act 2002. This enables a governing body to do anything which appears to them to be necessary or expedient for the purposes of, or in connection with, the conduct of the school.

It will be for the school to establish that it - and its contractors - are acting lawfully in collecting data and is, on a case-by-case basis, compliant with Human Rights and Data Protection duties and the common law of confidentiality. Schools should seek legal advice from their local authority where necessary.

Additionally, the government agency for ICT in Education, the British Educational Communications and Technology Agency (BECTA), have published guidance for schools in 2004 on their obligations and responsibilities under the Data Protection Act and other related legislation.

We and the Information Commissioner are aware of the concerns people, especially parents, have over the widespread use of biometrics, including fingerprints, and we will be meeting with ICO staff in the coming weeks in order to agree on what guidance might be useful.

In accordance with the DfES advice the following supporting guidance is offered by Bexley Council to assist schools when making decisions about the use of biometric data.

1) Schools are required to ensure that they have secure systems to ensure that any biometric information cannot be accessed by other individuals or organisations unauthorised to do so. Biometric data can only be used for the purpose originally intended.

2) Consideration will need to be given to the practicality of the proposed systems and the financial cost involved as well as the implications for any disabled student; eg placement of entry pads.

3) Schools are advised to consult widely with parents before taking decisions about the use of the biometric systems explaining the full purpose of the proposed system and the security measures that will be put into place.

4) Where students are able to give legal consent for bio-medical data to be retained by the school, a record of their permission should be retained alongside an acknowledgement that they fully understand the implications of their decision.

5) Where the use of biometric recognition systems are already in place and are a recognised part of the schools published procedures, consideration should only be given in exceptional circumstances to requests to opt out of the system. There would be an expectation that students/pupils should follow school procedures unless there were extremely good reasons for doing otherwise.

6) Where students do not give approval they should not be penalised for exercising their right not to do so but reasonable alternative procedures should be put into place.

7) Where the student/pupil is under the age of 16 and therefore are unable to give consent, parents approval would need to be given. There is a duty of confidentiality to the child and information cannot be released without the child's permission except where failure to do so might lead to a risk to the physical or emotional well being of the child.

8) Consideration should be given to informing the governors of any proposal to introduce biometric systems.

"According to our LEA, we have no record of any Buckinghamshire school using biometric technology. Although this information is not held by Bucks County Council, in practice most schools will consult me for data protection advice on such matters. I was asked some time ago for advice by a Primary school thinking about using the technology. The school subsequently decided not to use the biometric part of the software but I attach the advice I gave at the time including a note received some years ago from the Information Commissioner's office. It is probably worth noting that the Commissioner's letter was written in 2001 and technology has undoubtedly moved on since then."

"Our view is that [fingerprint recognition] is still too unreliable to be implemented in schools. The Council does not therefore have a policy on this matter...
